Earlier this week the 5th Circuit U.S. Court of Appeals issued a temporary stay, overturning a decision from a district court judge that enacted a restraining order on Texas’ Fetal Heartbeat Bill.
Fox reported, The appeals court decision means the abortion law is reinstated pending further legal actions. In his earlier decision, Pitman referred to the law as an “offensive deprivation” of the constitutional right to an abortion.
The bill is a practical solution to end abortion after a fetus obtains a heartbeat, without punishing mothers who seek to medically abort their child.
The act does not criminalize abortions, but rather subjects physicians that preform them to civil cases, and holds them accountable for damages.
The bill will allow lawsuits to be brought against doctors that proceed with abortions even after a heartbeat is detected in the unborn human.
The bill specifically states that a woman on whom an abortion is preformed on is not subject to any civil or prosecutorial action.
Texas Attorney General Ken Paxton said, “Great news tonight, The Fifth Circuit has granted an administrative stay on #SB8. I will fight federal overreach at every turn,” in a tweet.
